Terms and Conditions
The KIKO ME loyalty programme is managed by KIKO S.p.A. (hereinafter “KIKO”), a company incorporated under Italian law, with its registered office in Bergamo (Italy), at Via Guido e Giorgio Paglia n.o 1/D, registered with the Bergamo Companies Register, tax code 12132110151 and VAT number 02817030162 ("Sponsor" or "KIKO”).
KIKO is the global owner of the websites and mobile apps, as well as the "KIKO" brand. KIKO COS RETAIL MEXICO S. DE R.L. DE C.V. (hereinafter "KIKO Mexico”), Calle
Arquímedes número 15, Interior 427 Piso 4, Colonia Polanco V Sección, Alcaldía Miguel Hidalgo, C.P.11560 operates in Mexico. KIKO Mexico is controlled by KIKO, and both belong to the same Group (hereinafter "KIKO Group").
These Terms and Conditions, together with KIKO’s Privacy Policy (the "Privacy Policy”) https://www.kikocosmetics.com/en-mx/help/privacy-policy/, which together shall be referred to as the “Programme Terms and Conditions”, apply to participation in the KIKO ME Programme (as defined below).
1. This KIKO ME loyalty programme ("Programme") is open to any customer aged 18 or over. The participating countries where customers can sign up for the Programme and access its benefits are: Italy, Bahrain, Jordan, Kuwait, Oman, Qatar, the United Arab Emirates, the United States, France, Germany, Switzerland, Belgium, Spain, Portugal, Andorra, the United Kingdom, the Netherlands and Mexico.
The programme is only available in shops belonging to the KIKO group (KIKO product retail websites, KIKO counters in shopping centres and vending machines are excluded from the programme). 2. No purchase is necessary to sign up for a KIKO Me account ("Account”) and become a member (“Member" or "Members”), but a purchase is required to earn points and progress through the different tiers of the Programme (see clause 6 for further details). A valid email address is required.
3. Programme Period: The Programme will begin on 16 December 2024 and will remain available until further notice, which will be provided in the KIKO store and via email. Account holders will be notified by email two months before the programme ends.
4. Becoming a Programme Member: From the Programme launch date specified in clause 3, customers must visit a KIKO store and sign up by providing their personal details (full name, email address and date of birth) and, where applicable, their telephone number and delivery address as optional details, accepting the Programme Terms and Conditions to create an account and become a Member.
When a new member registers their personal details or creates an account, KIKO will also request consent for the processing of personal data (as set out in KIKO’s Privacy Policy) for marketing and profiling activities, which are not mandatory for joining the Programme but which, if provided, allow members to fully enjoy the Programme experience.
5. Members are not permitted to enrol in the Programme more than once. If it is found that a member has registered for the Programme more than once, KIKO reserves the right to suspend or cancel that member’s account.
6. Earning Points: From the Programme launch date, members can earn points by following the instructions below:
a. In-store: At the time of payment, before completing the transaction, members must indicate their participation in the Programme in one of the following ways:
i. by scanning their QR code using their personal device
ii. by showing the email received during registration
iii. by providing the email address used when registering for the programme
b. For every 25 MXN spent in a KIKO store in the countries listed in section 1, one (1) point will be credited to the member’s account.
7. Members will not be able to earn points on previous in-store purchases. Furthermore, points corresponding to a transaction completed without the Member having been previously identified in accordance with clause 6a or 6b cannot be obtained retrospectively.
8. Exceptions:
Points will not be calculated or awarded to members for purchases or transactions of less than 25 MXN.
Points will be calculated based on the total price of the products and services, and will be awarded by rounding down to the nearest whole number.
Points will not be calculated or awarded for delivery charges or gift wrapping.Points will not be calculated or awarded to members for the purchase of a gift card; however, points will be awarded for using a gift card as a method of payment for a purchase.
9. Membership Tiers ("Levels") in the Programme:
Level 1 ("Stylish"): Members who have earned between 0 and 50 points over a 12-month period will be eligible for this level.
Level 2 ("Artistic"): Members who have earned between 51 and 100 points over a 12-month period will be eligible for this level.
Level 3 ("Creative"): Members who have earned more than 100 points over a 12-month period will be eligible for this level.
10. Further Details and Conditions Regarding the Levels:
Upon signing up for the Programme, all new Members will automatically be enrolled in the Stylish tier, where they will remain for a period of 30 days.Once this 30-day period has elapsed, Members will be eligible for the tier corresponding to the total value of purchases made during that period, minus the value of any returned items, and will remain in that tier for the following 11 months.
Programme Members who make a second purchase of over 750 MXN may choose a “WELCOME BACK” gift from a list of products, which will be displayed in-store and is subject to availability (one-time offer).
At the end of the first 12-month period following enrolment, the tier to which a Member is assigned will depend on the number of points they have accumulated over the previous 12 months.
At the start of each new 12-month period, the number of points a member has accumulated over the previous year will be reset to zero, and the member will move up a tier, move down a tier or remain at the same tier depending on the number of points accumulated during the previous 12-month period.
The benefits of each tier cannot be used in conjunction with other offers, such as discounts and discount codes.
f. New Members and Stylish Members Will Receive the Following Benefits:
Members will receive a birthday gift of their choice from a list of products that will be displayed in the shop, subject to availability, when making a purchase in the shop during the week before their birthday (the date specified when the account was created) and for a period of thirty days following this date.
g. Artistic Members Will Receive the Following Benefits:
In addition to the benefits available to Stylish members, Artistic members will also be able to receive a complimentary 30-minute beauty consultation at one of the KIKO stores participating in the programme (subject to availability). This benefit can only be redeemed once.
Artistic Members can also gift someone else an in-store consultation (subject to availability). This benefit can only be redeemed once.
Artistic Members will also receive, once for each year of their subscription at Artistic Level 2, a gift of their choice (from a list of products that will be displayed in the shop and subject to availability) with a purchase of at least 750 MXN. The gift will only be provided on condition that none of the items in the purchase are subject to any promotional offers (discounts, special offers, sales, buy one get one free, etc.).
h. Creative Members Will Receive the Following Benefits:
In addition to the benefits available to Artistic Members, Creative Members will also receive an extra beauty consultation at one of the KIKO stores participating in the Programme. To avoid any doubt, it must not be gifted to anyone else.
KIKO reserves the right to offer Members at different levels exclusive offers, invitations to events and updates throughout their membership. All applicable terms and conditions will be clearly set out in the offer.
Members may only use one offer per purchase.
Members can earn points and enjoy benefits in all countries participating in the Programme.
11. Deadlines for Crediting Points:
Bonus points awarded to Members will be credited to the Member’s account within the timeframe specified on each occasion, unless technical issues cause a delay in the awarding of the points.
12. Checking your Points Balance: Members can check their accumulated points balance in KIKO stores or by checking their digital card linked to the Programme.
13. Cancellation of Points: In the event of a full or partial return of items or services purchased in-store for which points have been awarded (for example, if the member exercises their right of withdrawal or terminates the contract, or if they return the items relating to the purchase for which the points were awarded), KIKO will cancel the points awarded in proportion to the amount refunded and based on the points earned upon completion of the transaction.
14. Account Closure:
Members can cancel their account and subscription at any time by contacting Customer Care at customercare-mx@kikocosmetics.com.
KIKO may exclude a member from the Programme, revoking their membership with immediate effect on valid grounds, and notifying the member in writing of the reasons for doing so. The reasons include, amongst others, fraudulent or abusive use of the Programme or other breaches of the Programme’s Terms and Conditions or applicable legislation. Account closure will mean that points can no longer be earned on purchases, and will result in the loss of benefits linked to their membership tier. Any points earned previously will also be forfeited and cannot be used or transferred to another member.
15. Personal Use: Only members who make purchases for their own personal use will be able to earn points. Therefore, members who make purchases for commercial or professional purposes are excluded.
16. Amendment: KIKO reserves the right to amend or modify the Programme’s Terms and Conditions, ensuring that any changes made do not affect the rights already acquired by members. Any changes made will be communicated to members via specific email notifications.
17. Suspension or Early Termination of the Programme: KIKO may suspend or terminate the Programme in accordance with the timeframes set out in clause 3. Early termination and suspension (with the corresponding consequences) shall be communicated to members at least 30 days in advance or, in the case of suspension, as far in advance as possible or, at the latest, immediately after it takes effect. We use KIKO’s communication channels: via email, at Kiko stores or through other modes of communications relating to the Programme.
18. KIKO Customer Services: Members can contact KIKO Customer Service (customercare-mx@kikocosmetics.com) with any questions or complaints regarding the Programme and, for matters relating to the processing of their personal data, the Data Protection Officer ("DPO") at the email address dpo.kiko@kikocosmetics.com.
19. KIKO’s aim is to ensure the Programme is fair and secure and to prevent fraudulent use. If a member acts in a manner that is inconsistent with these Terms and Conditions, their account will be closed. Any benefits or points awarded may be revoked and reclaimed, and KIKO reserves the right to bar the member from participating in the Programme for a minimum period of six months. For this reason, KIKO reserves the right to:
disqualify members who manipulate the Programme or who, in any other way, fail to comply with the requirements of these Terms and Conditions.
cancel, amend or suspend the Programme should it be unable to proceed as planned for reasons including, but not limited to, manipulation, unauthorised interference, fraud, dishonesty, technical faults or any other cause beyond KIKO’s control that undermines or affects the administration, security, impartiality, integrity or proper conduct of the Programme.
20. The benefits and points awarded under the Programme are non-transferable and non-exchangeable, and cannot be exchanged for cash or any other form of compensation. If, for any reason, a benefit is unavailable, KIKO reserves the right, at its sole discretion, to replace that benefit or part thereof with another of equal or greater value.
21. KIKO, its agencies and associated companies shall not be liable for any loss (including, but not limited to, indirect, special or consequential losses or loss of profit), expense or damage suffered or incurred (whether or not due to the negligence of any person) in connection with this Programme or with the acceptance or use of the benefits, except in the case of any liability that cannot be excluded by law. Nothing shall exclude KIKO’s liability for death or personal injury resulting from its negligence.
22. KIKO shall not be liable for any delay or failure to perform its obligations due to causes beyond its reasonable control or force majeure, such as global or regional epidemics or pandemics, adverse weather conditions, fires, industrial disputes, wars, terrorist acts, acts of aggression, political unrest, riots, civil unrest, plagues or other natural disasters, or any other circumstances.
23. All personal data provided for an account will be used for the purposes of the Programme and for research and analysis by KIKO Mexico or any agent or supplier appointed by KIKO to assist, on behalf of KIKO, in the administration of the Programme. Personal data will not be disclosed to third parties outside the company unless express consent has been obtained. Personal data will be processed in accordance with KIKO’s Privacy Policy, available at: https://www.kikocosmetics.com/en-mx/help/privacy-policy/
24. If any provision of these Terms and Conditions is held to be legally invalid, unlawful or unenforceable, the remaining provisions shall remain unaffected and shall continue in full force and effect.
25. By creating an account, the member is deemed to have accepted these Terms and Conditions and is bound by them.
